These Terms and Conditions (“Terms”) govern your membership and use of services provided by Creatricity (“we,” “our,” or “us”). By signing up for membership and using our services, you agree to be bound by these Terms. Please read them carefully.

Membership Duration and Renewal:
One-year term as of the date of signing, with monthly or annual payment options. Auto-renewal unless canceled quarterly.
Dispute Resolution:
Any disputes arising from or relating to the membership or these Terms shall be resolved through mediation, and if necessary, binding arbitration. Both parties agree to participate in good faith to reach a mutually acceptable resolution.
Any legal action or proceeding arising from or relating to the membership or these Terms shall be filed exclusively in the courts of New York, Kings County, and the parties consent to the jurisdiction and venue of such courts.
Limitation of Liability:
Creatricity shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or reputation, arising out of or in connection with the membership or use of Creatricity’s services.
Creatricity’s total liability, if any, whether based on contract, tort, negligence, or otherwise, shall not exceed the fees paid by the member to Creatricity during the six months preceding the event giving rise to the liability.
Member agrees that such monetary damages shall be the sole and exclusive remedy Member is entitled to and such remedy is fair and just. Member shall not be entitled to, and will not seek any other reimbursement, payment, claims, or damages.
Intellectual Property:
All intellectual property rights, including copyrights, trademarks, and proprietary information, related to Creatricity’s platform, resources, and materials, shall remain the sole and exclusive property of Creatricity. Members shall not use, reproduce, or distribute any intellectual property without Creatricity’s prior written consent.
Indemnification:
Members agree to indemnify, defend, and hold Creatricity, its directors, officers, employees, and affiliates harmless from any claims, damages, liabilities, costs, or expenses arising from the member’s use of Creatricity’s services, violation of these Terms and Conditions, or infringement of any third-party rights.
Representations and Warranties:
Member warrants and represents that Member:
- Has the full right, power, and authority to enter into this agreement.
- Shall keep all information obtained, accessed, or obtained through Creatricity confidential.
- Shall not make any disparaging, false, or negative statements against Creatricity or other members, assigns, licensees, or contractors of Creatricity.
Termination and Refunds:
No refunds shall be provided for early membership cancellation.
Immediate termination may occur for a breach of our code of ethics or any representation or warranty, with no refunds provided.
By signing up, you agree to abide by these Terms and Conditions.
These Terms and Conditions are subject to change at our discretion. It is your responsibility to review these Terms periodically for updates or changes. Your continued use of our services after any modifications indicates your acceptance of the revised Terms. If you do not agree to abide by these Terms, please do not sign up for membership or use our services.
